Kerala High Court Directs Removal of Unapproved Banners, Boards, Flags, and Decorations from Crowded Roads.

The Kerala High Court has instructed the removal of unauthorized signs, flags, and decorations from busy roads. This decision came from a Writ Petition. Justice Devan Ramachandran emphasized, “I instruct the Secretaries of every Local Self Government Institution (LSGI) to remove all unauthorized items within ten days.” Amicus Curiae Sri Harish Vasudevan reported ongoing violations. The Court acknowledged the situation but noted that little can be done if officials remain indifferent or inactive. The Government Pleader stated that the State is dedicated to eliminating unauthorized items and mentioned that while measures have been taken, the responsibility ultimately lies with the LSGIs.
The Court expressed the need to communicate with the Secretary of the Department of Local Self Government Institutions in Kerala, as previous suggestions from this officer have been largely ignored. The Court reiterated that the LSGI Secretaries are responsible not only for removing the unauthorized items but also for collecting fines and filing FIRs. Committees were formed to support those who felt pressured to act, but this does not exempt them from their duties, the Court remarked.
The Court was not satisfied with the idea that the Secretaries of the LSGIs are afraid to act due to pressure from certain interests. It stated, “…this Court must instill the fear of the law in them and help them understand that it holds more power.” The Court then ordered the Secretary of the Department of LSGI to join the next hearing online. “I emphasize that any unauthorized boards, flags, or decorations still on public streets will be the personal responsibility of the Secretaries; this Court will have no choice but to impose fines on them personally,” the Court added.
